Guardian Ad Litem

A lawyer was appointed guardian ad litem in a case in which the son of the person with alleged disabilities was seeking to remove life support. The lawyer was told that the patient was in a deep coma and was dying from lung cancer. The court directed the lawyer to go out on a very expedient basis and then return for a hearing. After spending hours with the doctors and medical team, the lawyer then went in and attempted to communicate with the alleged disabled person. The lawyer got down and spoke very loudly into the patient’s ear (the patient was wearing an oxygen mask) and told the patient the reason for his visit. The patient promptly sprung up out of bed, used a variety of profanities relative to his son and indicated that he was sure his son had come to town to get his money because he hadn’t seen him in about 10 years. The fact that the third-party guardian ad litem was able to go and advise this man of the situation, the existence of this case against him to remove life support, and the fact that it worked because he obviously opposed the removal of life support is demonstrative of the due process system that’s in place to protect people’s rights. This man was on the verge of being taken advantage of, and in essence losing his life.
